It is unlawful to keep, harbor or own or in any way possess within the city any pit bull dogs; provided, that pit bull dogs registered with the city on the date of the publication of the ordinance codified in this chapter may be kept within the city subject to the standards and requirements as set forth in the following sections of this chapter. Pit bull dog means:

(1)   The bull terrier breed of dog;

(2)   Staffordshire bull terrier breed of dog;

(3)   The American pit bull terrier breed of dog;

(4)   The American Staffordshire terrier breed of dog;

(5)   Dogs of mixed breed or of other breeds than above listed which breed or mixed breed is known as pit bulls, pit bull dogs, or it pit bull terriers;

(6)   Any dog which has the appearance and characteristics of being predominantly of the breeds of bull terrier, Staffordshire bull terrier, American pit bull terrier, American Staffordshire terrier, or any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers, or a combination of any of these breeds.

(a)   It is unlawful to keep, harbor or own or in any way possess within the city any Rottweiler dogs; provided, that Rottweiler dogs licensed with the city within six (6) months of the date of the publication of Ordinance No. 1008 may be kept within the city provided their licensure remains current. Rottweiler dog means:

(1)   The Rottweiler breed of dog;

(2)   Any mixed breed which contains as an element of its breeding the breed of Rottweiler as to be identifiable as partially of the breed of Rottweiler;

(3)   Any dog which has the appearance and characteristics of being predominantly of the breed of Rottweiler.

Any dog found to be the subject of a violation of this chapter shall be subject to immediate seizure and impoundment.

Any person violating or permitting the violation of any provision of this chapter shall, upon conviction in municipal court, be fined a sum not less than $150.00 and not more than $1,000.00. In addition to the fine imposed the court may sentence the defendant to imprisonment in the county jail for a period not to exceed 30 days. In addition, the court shall order the dog removed from the city. Should the defendant refuse to remove any dog found to be the subject of a violation of this chapter from the city, the municipal court judge shall find the defendant owner in contempt and order the immediate confiscation and impoundment of the animal. Each day that a violation of this chapter continues shall be deemed a separate offense. In addition to the foregoing penalties, any person who violates this chapter shall pay all expenses, including shelter, food, handling, veterinary care and testimony necessitated by the enforcement of this chapter.
