CHAPTER 14. TRAFFICCHAPTER 14. TRAFFIC\Article 5. Work Site Utility Vehicles/Micro Utility Trucks/Golf Carts

Except as provided herein, it shall be unlawful for any person to operate, or to allow the operation of, a work site utility vehicle (WSUV), or a micro utility truck (MUT), as defined by the Standard Traffic Ordinance for Kansas Cities, within the corporate limits of the City of Hiawatha, Ks. The following limited operation of said vehicles is hereby authorized:

(a)   Operation shall be limited to between sunrise and sunset, by persons possessing a valid license to operate a motor vehicle, and that are not less than 17 years of age. No such vehicle shall be operated between sunset and sunrise unless equipped with lights as required by law for motorcycles.

(b)   Operation shall be prohibited on 1st Street (US 73), and Oregon Street, not to include when crossing these streets at intersections excepts when designated by the governing body.

(c)   Any such vehicle shall be equipped with properly functioning brakes and steering mechanism, functioning tail lights or readily visible red reflectorized warning devices on the rear, and a mirror so located as to reflect to the driver a view of the public streets to the rear of the vehicle.

(d)   Any such vehicle must be registered with the City of Hiawatha prior to operation. To register, the owner of such vehicle shall make application to the city for an annual permit to operate such vehicle, providing such information as required by the city on a form prescribed by the city, and shall pay the required annual fee. The registration year shall be from January 1st through December 31st of each year. The fee shall be payable before March 1st of each year without penalty. Late registrations of previously registered vehicles shall be subject to a $5.00 penalty. Such information shall include the name(s) and address(es) of the owner(s), the vehicle identification number (VIN), and a description of the vehicle make and model. A police officer from the city shall inspect the vehicle for application. The annual fee shall be $25 or as otherwise established by the city from time to time. Upon proper application, payment of such fee, and inspection by a city police officer, the city shall issue a permit to operate that shall include a sticker that the owner must attach to the rear portion of the vehicle in a conspicuous and visible location. Such permit can be revoked for violations of this section in the sole discretion of the city commission and/or municipal judge.

Registration decal transfer to another vehicle upon sale of the registered vehicle: There will be a $5.00 transfer fee of decal to new vehicle, if owned by same owner as prior vehicle. It is also mandatory to have the new vehicle inspected prior to transferring registration from one to the other.

(e)   Persons shall ride on such vehicles only upon the permanent and regular seats attached thereto, and the operator shall only transport the number of persons the vehicle is designed to carry. No operator shall transport a person or object that will interfere with the safe operation or control of the vehicle.

(f)   Such vehicles must be covered by liability insurance for bodily injury and property damage, and such coverage shall be in an amount not less than the minimum policy amounts for such coverage as required by Kansas law for insured vehicles of the same type.

(g)   All such permitted operation shall be in an otherwise safe and responsible manner, subject to all traffic laws and rules of the road, and at speeds not exceeding 20 m.p.h.

It shall be unlawful for any person to operate, or to allow the operation of, an all-terrain vehicle, as defined by the Standard Traffic Ordinance for Kansas Cities, within the corporate limits of the City of Hiawatha, Kansas.

Any terms or provision of the Standard Traffic Ordinance for Kansas Cities relating to work-site utility vehicles, micro utility trucks and golf carts that are in conflict herein shall not be applicable, as the same may be adopted, amended and in effect from time to time in the city.

Any person convicted of a violation of this article shall be subject to penalty as provided in Article 20 Section 201 of the Standard Traffic Ordinance for Kansas Cities, as adopted by the City of Hiawatha, Kansas or such other general penalty section of said STO in replacement thereof, as the same may be amended from time to time.
